| description | Insolvency regimes are procedures established by national legislation in which a person, whether natural or legal, trader or non-trader, may face the economic adversities that impede them from paying their debts, and consequently impact their legal, economic, social and family spheres.
Even though these regimes are legal adaptations embraced by Colombia, with the aim of implementing diverse strategies to deal with insolvent debtors, the principal emphasis is based on debt restructuring practices, and not on the liquidation or elimination of the debtors’ assets. This perspective allows a reshaping of the financial and organizational structure of debtors with economic difficulties to enable the restoration and continuity of their businesses and activities, allowing them to remain current and active in the monetary cycle.
Based on the above, the purpose of this book is to show the community and the academia the progress and evolution of these procedures, how they operate within the national legislation and how they have been interpreted through the decisions of the high courts, offering a harmonic and systematic vision, which refutes false interpretations and expose in its reality this legal subject. |

Los regímenes de insolvencia son procedimientos que establece la legislación nacional para que una persona, natural o jurídica, comerciante o no comerciante, afronte las adversidades económicas que le impidan pagar sus deudas, para evitar que, como consecuencia, se impacten sus esferas jurídica, económica, social y familiar. Aunque dichos regímenes son trasplantes jurídicos adoptados por Colombia, con el propósito de implementar diferentes estrategias para enfrentar el gran problema de los insolventes, el enfoque principal se basa en las prácticas de reestructuración de las deudas, y no en la liquidación o eliminación del patrimonio de los deudores. Esta perspectiva permite la remodelación de la estructura financiera y organizativa de los deudores que experimentan dificultades económicas. De esa forma, se propende por la rehabilitación y continuidad de sus negocios y actividades, lo que les permitiría mantenerse vigentes y activos en el ciclo monetario. Con miras a que sea leído por la comunidad y la academia, este libro tiene como propósito evidenciar la evolución y logros de los procedimientos legales vinculados con la insolvencia económica, además de revisar la forma como operan dentro de la legislación nacional y como han sido interpretados por las providencias de los altos tribunales. Para ello, y con el fin de desmentir algunas falsas interpretaciones, se ofrece una visión armónica y sistemática que expone en su compleja realidad esta temática jurídica.
