El presente artículo se encarga de discernir respecto de la amalgama de sistemas que dan como resultado el sistema de contratación colombiano, dentro del cual la distinción entre los contratantes privados y públicos que proviene del enfoque francés, junto con la aplicación del derecho común tanto a los contratantes privados como estatales proveniente del modelo angloamericano y su ejercicio del principio de igualdad se ven unificados en un sistema multifacético que genera resultados diferentes de sus referentes, el cual tiene la capacidad de colaborar a un mejoramiento de las condiciones de la contratación contribuyendo al equilibro contra cual dentro de los contratos administrativos.
