El presente articulo aborda una revisión alrededor de dos conceptos fundamentales para entender las dinámicas del derecho administrativo y el derecho constitucional, en donde se aborda a partir de los alcances del principio de legalidad si este ultimo integrado a un Estado constitucionalidad implica que el mismo sea considerado como un principio de constitucionalidad, frente al cual, una de las consideraciones tiene una determinación que afecta todas las instituciones dogmáticas del derecho administrativo, frente al cual se analiza si ello aplicado a una revisión de la caducidad procesal en los procesos de reparación directa derivados del conflicto armado interno, genera un condicionamiento que implica un proceso de constitucionalización, como consecuencia de esto, es necesario realizar una revisión y presupuestar las consecuencias de lo que ello genera para el ordenamiento jurídico interpretado a la luz de la constitución.
