The article focuses on the role played by the executive and the legislative branches in the current sanitary emergencyand how the present context has affected the interaction between both branches. In dealing with the sanitary crisis, public authorities have adopted measures that resemble some of the policies implementedto confront the social crisis taking place in the country since October 2019. Therefore, this essay observes the continuities and interruptions registered in the institutional response to those crises. The aim of suchanalysis is to shed light on the meaning of such responses for Chilean presidentialism, understood both as a political culture and as a legal approach to public management. In order to assess the current pertinence of the separation of powers doctrine in the Chilean case, two conflicting theoretical perspectives are used, namely the administrative-state approach provided by Posner & Vermeule and the deliberative model suggested by Ginsburg & Versteeg. The paper concludes by offering a differentiated perspective onthe current situation, centring the analysis on some aspects relevant to the ongoing process of creating a new constitution for the country.

El presente artículo ofrece un análisis de la reacción institucional a la pandemia de  COVID-19 en el caso chileno, centrándose en el rol de los poderes ejecutivo y legislativo, así como en el impacto que el contexto actual ha tenido en las dinámicas de interacción entre ambos poderes del Estado. Las formas de control de la crisis sanitaria encuentran un antecedente directo en las formas de control implementadas para reaccionar a la crisis social iniciada en octubre de 2019. Dado lo anterior, el escrito detecta las continuidades e interrupciones identificables en las respuestas a ambas crisis, analizando qué representa la trayectoria institucional del último año para el presidencialismo chileno en tanto cultura política y forma jurídica degestión del poder público. La evaluación del caso chileno se realiza a partir de la tensión entre dos modelos de análisis para estudiar la vigencia actual del principio de separación de poderes: por un lado, la propuestadel ejecutivo desatado, desarrollada por Posner y Vermeule; por otro lado, el modelo deliberativo expuesto por Ginsburg y Versteeg. El artículo concluye brindando una perspectiva propia a modo de diagnóstico dela situación actual, analizando elementos de diseño institucional que resultan relevantes para el proceso constitucional actualmente en curso en el país. Este artigo oferece uma análise da reação institucional à pandemia COVID-19 no caso chileno, enfocando o papel dos poderes executivo e legislativo, bem como o impacto que o contexto atual teve na dinâmica deinteração entre os dois poderes do Estado. As formas de controle da crise de saúde encontram um antecedente direto nas formas de controle implementadas para reagir à crise social iniciada em outubro de 2019. Diante do exposto, o documento detecta continuidades e interrupções identificáveis nas respostas às crises, analisando o que a trajetória institucional do último ano representa para o presidencialismo chilenocomo cultura política e forma jurídica de gestão do poder público. A avaliação do caso chileno é feita a partir da tensão entre dois modelos de análise para estudar a vigência atual do princípio da separação de poderes: de um lado, a proposta do executivo desencadeado, desenvolvida por Posner e Vermeule; por outro lado, o modelo deliberativo exposto por Ginsburg e Versteeg. O artigo conclui apresentando uma perspectiva própria como diagnóstico da situação atual, analisando elementos de desenho institucional relevantes para oprocesso constitucional em curso no país.
