Consequently, the legal and jurisprudential development that has sustained the impossibility of resigning, suspending or interrupting the criminal action in cases of serious crimes against minors will be explained. However, despite the existence of express legal prohibitions, it will be argued why it is possible to fully apply the principle of opportunity in cases in which the legal prohibitions contradict norms, principles and values of constitutional hierarchy. In this vein, it will be justified that in those cases in which the prohibition of applying the principle of opportunity leads to the violation of the principle of proportionality, fundamental rights and the constitutional principles of criminal law, the exception of unconstitutionality should be applied. to respect the supremacy of the Political Constitution. |

En el presente artículo se abordan los límites institucionales, reglamentarios, judiciales y las prohibiciones legales para aplicar el principio de oportunidad en delitos dolosos contra menores, desde el Código de Infancia y Adolescencia, así como las reformas al Código de Procedimiento Penal. Consecuentemente, se explicará el desarrollo legal y jurisprudencial que ha sustentado la imposibilidad de renunciar, suspender o interrumpir la acción penal en casos de delitos graves contra menores. Sin embargo, a pesar de la existencia de expresas prohibiciones legales, se argumentará el porqué es posible dar plena aplicación del principio de oportunidad en los casos en los que las prohibiciones legales contradicen normas, principios y valores de jerarquía constitucional. En este orden de ideas, se justificará que en aquellos casos en los que la prohibición de aplicar el principio de oportunidad conduzca a la vulneración del principio de proporcionalidad, los derechos fundamentales y los principios constitucionales del derecho penal, se debe aplicar la excepción de inconstitucionalidad para respetar la supremacía de la Constitución Política.
