Es común referirse al derecho a la libertad de expresión como base o sustento de la democracia; sin embargo, pocas veces se analizan las implicaciones en la teoría constitucional de esta afirmación. Este artículo sostiene que la protección constitucional de la sátira política es fundamental para el Estado y la democracia, ya que fortalece el mecanismo de frenos y contrapesos, y el equilibro de poderes, que en naciones como Colombia no se ha consolidado. En este sentido, partiendo de la formulación clásica de la doctrina de la división de poderes y su aplicación en Latinoamérica, se analizará la incidencia de la sátira política en el Estado moderno.
