description This article analyzes some doctrinal and political disputes that took place over how the exercising of popular sovereignty should assume the construction of the Argentinian state. The focus is on the controversies brought about by the legislation of popular juries for the administration of justice. With those objectives, and from a perspective of political-intellectual history, the article approaches the forum of controversies that was constituted around academic production in the University of Buenos Aires and the legislative debates that took place in the National Congress. It also takes into consideration articles published in cultural and legal journals which articulated,fed and amplified the spread of those discussions. The main argument is that the dissidences that gave way to that form of popular sovereign exercise went back to the disputes over what the place of the people was in the government of the republic, and that its lack of implementation was linked to the triumph of a form of republican functioning which privileged popular demobilization as a means to secure political stability.

Este artículo analiza algunas disputas doctrinarias y políticas que se dieron sobre las formas que debía asumir el ejercicio de la soberanía popular durante la construcción del estado argentino. Centra su atención, especialmente, en las controversias desatadas por la reglamentación de los jurados populares para la administración de justicia. Con esos objetivos, y desde una perspectiva de historia político-intelectual, aborda el foro de polémicas que se constituyó en torno a la producción académica en la Universidad de Buenos Aires y a los debates legislativos que tuvieron lugar en el Congreso de la Nación. Pero atiende también a los artículos publicados en revistas culturales y jurídicas, que articularon, alimentaron y amplificaron la difusión de esas discusiones. El argumento principal es que las disidencias que desató esa forma de ejercicio soberanía popular remitían a las contiendas sobre cuál debía ser el lugar concreto del pueblo en el gobierno de la república, y que su falta de implementación se ligó al triunfo de una forma de funcionamiento republicano que privilegió la desmovilización popular como medio para asegurar la estabilidad política. Cet article analyse quelques disputes doctrinaires et politiques sur les formes qui devait assumer l’exercice de la souveraineté populaire pendant la construction de l’État argentin. On se concentre notamment sur les discussions menées à la suite de la réglementation des jurys populaires pour l’administration de justice. Pour ce faire, en faisant appel à une perspective d’histoire politico-intellectuelle, on reprend les polémiques suscitées à l’Université de Buenos Aires et aux débats législatifs ayant eu lieu à l’Assemblée de la Nation. Mais on fait grand cas aussi des articles publiés dans des revues culturelles et juridiques qui ont nourri et amplifié la diffusion de ces discussions. L’argument principal c’est que le dissidences provoquées par cette forme de souveraineté populaire renvoyaient aux disputes dont le but était de savoir quel devait être le rôle du peuple dans le gouvernement de la république, et que l’absence du peuple a donné lieu à un gouvernement républicain ayant fait appel à la démobilisation populaire comme moyen pour assurer la stabilité politique.
