Existen serias falencias de naturaleza racional, estructural y material en el ordenamien to procesal disciplinario en Colombia, el cual, lejos de ser una manifestación del Estado Social de Derecho, se erige como un sistema de orden inquisitivo, arbitrario y subjetivo en el que se instrumentaliza al individuo, despojándolo de su condición de "fin en si mismo" (sujeto), y se le convierte en un objeto procesal, desconociendo así los postula dos esenciales del debido proceso. Existem graves falhas de ordem racional, estrutural e material na ordem processual disciplinar na Colômbia, que, longe de ser uma manifestação do Estado Social de Direito, constitui um sistema de ordem inquisitiva, arbitrária e subjetiva em que se encontra. instrumentalizou o indivíduo, despojando-o de sua condição de “fim em si mesmo” (sujeito), e ele se torna um objeto procedimental, ignorando assim os postulados essenciais do devido processo.
