Explaining how the obligations imposed by International Law on the States in a treaty can vary due to changed circumstances (rebus sic stantibus), without affecting the fulfillment of the object and purpose of the Treaty, nor creating obligations for third parties, constitutes the objective of this article, which from the methods, legal history, and synthesis analysis, demonstrates that the obligations imposed by the Charter of the United Nations prevail over the obligations contracted in another international agreement, in any circumstances, constituting respect for the norms ius cogens, a limit to the action of the State due to the change of circumstances.

La institución del stopell es perfectamente conocida en la doctrina continental como la teoría de los actos propios, que demuestra la fidelidad al principio pacta sunt servand; su naturaleza como principio general del Derecho es autónoma y opera a la sombra de las negociaciones bilaterales o multilaterales cuyo soporte transita por la confianza mutua. Explicar cómo las obligaciones impuestas por el Derecho Internacional a los Estados en un tratado, pueden variar por el cambio de circunstancias (rebus sic stantibus), sin afectar el cumplimiento del objeto y fin del Tratado, ni crear obligaciones para terceros, constituye el objetivo de este artículo, que a partir de los métodos, histórico jurídico, y análisis síntesis, demuestra que las obligaciones impuestas por la Carta de Naciones Unidas prevalece por encima de las obligaciones contraídas en otro convenio internacional, en cualquier circunstancias, constituyendo el respeto a las normas ius cogens, un límite a la actuación del Estado por el cambio de circunstancias. A instituição stopell é perfeitamente conhecida na doutrina continental como a teoria dos atos próprios, o que demonstra fidelidade ao princípio pacta sunt serand; sua natureza de princípio geral de direito é autônoma e opera à sombra de negociações bilaterais ou multilaterais cujo apoio se baseia na confiança mútua. Explicar como as obrigações impostas pelo Direito Internacional aos Estados em um tratado podem variar devido a mudanças nas circunstâncias (rebus sic stantibus), sem afetar o cumprimento do objeto e propósito do Tratado, nem criar obrigações para terceiros, constitui o objetivo de este artigo, que a partir dos métodos, histórico jurídico e análise de síntese, demonstra que as obrigações impostas pela Carta das Nações Unidas prevalecem sobre as obrigações contraídas em outro acordo internacional, em qualquer circunstância, constituindo respeito às normas ius cogens, limite à ação do Estado devido à mudança das circunstâncias.
