description In the Brazilian legal system, the term accreditation does not appear as a legal device. The terms used by the Brazilian legislation, whether for institutions, courses, programs, or academic degrees, are operation authorization, recognition, accreditation, recredentialing, and evaluation, carried out by the public power. The authorization verifies the suitability of an educational institution, public or private, to offer quality education. The recognition confirms (or not) this suitability. Accreditation verifies the institutional conditions of supply. The evaluation measures the adequacy of this set to the quality standard, a principle of education demanded by the Constitution. Accreditation is a non-statal process that, under the direction of private or governmental entities or Professional Councils, seeks quality control of professionals, of services rendered or products, under national or international technical standards (ISO, regulatory agencies, professional councils). In general, such entities evaluate quality by issuing a certification that verifies the quality of the service provided by professionals in practice, of services provided to users, or of products sold in the market. In this sense, accreditation is an ex-post academic-institutional certification that seeks to ensure the ability of these institutions to provide their graduates with quality standards.

En el ordenamiento jurídico brasileño, el término acreditación no aparece como dispositivo legal. Los términos utilizados por la legislación brasileña, ya sea para las instituciones, los cursos, los programas o los títulos académicos, son la autorización de funcionamiento, el reconocimiento, la acreditación, la recredencialización y la evaluación, realizados por el poder público. La autorización verifica la idoneidad de una institución educativa, pública o privada, para ofrecer una educación de calidad. El reconocimiento confirma (o no) esa idoneidad. La acreditación verifica las condiciones institucionales de la oferta. La evaluación mide la adecuación de este conjunto al estándar de calidad, un principio de la educación exigido por la Constitución. La acreditación es un proceso no estatal que, bajo la dirección de entidades privadas o gubernamentales o Consejos Profesionales, busca el control de calidad de profesionales, servicios o productos, bajo normas técnicas nacionales o internacionales (ISO, agencias reguladoras, consejos profesionales). En general, estas entidades evalúan la calidad emitiendo una certificación que verifica la calidad del servicio prestado por los profesionales en la práctica, de los servicios prestados a los usuarios o de los productos vendidos en el mercado. En este sentido, la acreditación es una certificación académico-institucional a posteriori que busca asegurar la capacidad de estas instituciones para proporcionar a sus graduados unos estándares de calidad. No ordenamento jurídico brasileiro, o termo acreditação não consta como dispositivo legal. Os termos de que a legislação brasileira se serve, seja para as instituições, os cursos, os programas, seja para os graus acadêmicos são autorização de funcionamento, reconhecimento, credenciamento, recredenciamento e avaliação, levados adiante pelo poder público. A autorização verifica a idoneidade de uma instituição de ensino, público ou privada para ofertar ensino de qualidade. O reconhecimento confirma (ou não) aquela idoneidade. O Credenciamento verifica as condições institucionais de oferta. A avaliação mede a adequação desse conjunto ao padrão de qualidade, princípio do ensino exigido pela Constituição. A acreditação é um processo não-estatal que, sob a direção de entidades privadas ou de entidades governamentais ou de Conselhos Profissionais buscam um controle de qualidade dos profissionais, dos serviços prestados ou de produtos, sob normas técnicas nacionais ou internacionais (ISO, agências reguladoras, Conselhos profissionais). Em geral, tais entidades avaliam a qualidade exarando uma certificação que verifica a qualidade do atendimento dos profissionais em exercício, de serviços prestados aos usuários ou de produtos vendidos no mercado. Nesse sentido, a acreditação é uma certificação ex-post formação acadêmico-institucional que busca zelar pela capacidade destas instituições em propiciar por seus egressos padrões de qualidade.
