description | The importance of labeling transgenic foods lies in the fact that labels constitute the communication mechanism between the producer and the consumer of a food; information that gives people the possibility to make rational decisions regarding food consumption, however, the omission regarding the mandatory labeling of transgenics present in Law 1480 of 2011, makes it difficult for people to exercise the right to make rational decisions regarding the consumption of transgenic foods. Consequently, the main objective of this article is to analyze the criteria of precaution and substantial equivalence applicable to the labeling of foods from genetically modified organisms -APOGM-, in order to make visible the importance of clear legal parameters in terms of labelled; understanding the labeling of transgenic foods as a presupposition to guarantee in Colombia the right to decide how to feed oneself, outlining the need for mandatory APOGM labeling to respond to the consumer's right to decide as a presupposition for human dignity and a protective mechanism for food sovereignty. With the aforementioned purpose, for the development of this article, the qualitative method was used, starting from the study of the APOGM labeling in the country and its incidence in terms of food sovereignty and guarantee of consumer rights, for this purpose the review of regulations, jurisprudence and scientific and academic literature on transgenic foods and their labeling; It is intended to glimpse the importance of strict food labeling, an issue that, referring to foods from genetically modified organisms, acquires relevance, since the label constitutes the means of control available to people to guarantee food sovereignty. |

La importancia del etiquetado de los alimentos transgénicos radica en que es el mecanismo de comunicación entre el productor y el consumidor de un alimento; información que da la posibilidad a las personas de adoptar decisiones racionales respecto el consumo de alimentos; sin embargo, la omisión respecto a su obligatoriedad –Ley 1480 del 2011– dificulta a las personas ejercer el derecho a adoptar decisiones racionales respecto el consumo de alimentos que, por lo general, contienen transgénicos. En consecuencia, el objetivo principal de este artículo, consiste en analizar los criterios de precaución y equivalencia sustancial aplicables en materia de etiquetado de Alimentos Provenientes de Organismos Genéticamente Modificados –APOGM–, con el fin de visibilizar la importancia de parámetros legales claros en materia de etiquetado; entendiendo el etiquetado de alimentos transgénicos como presupuesto para garantizar en Colombia el derecho a decidir cómo alimentarse, esbozando la necesidad de la obligatoriedad de etiquetado de APOGM para responder al derecho a decidir del consumidor como presupuesto de la dignidad humana y mecanismo protector de la soberanía alimentaria. Con el propósito mencionado, para el desarrollo del presente artículo, se acudió al método cualitativo, partiendo del estudio del etiquetado APOGM en el país y su incidencia en términos de soberanía alimentaria y garantía de los derechos del consumidor; para tal fin se acudió a la revisión de las normas, jurisprudencia y literatura científica y académica en materia de alimentos transgénicos y etiquetado de los mismos; se pretende vislumbrar la importancia del etiquetado estricto de los alimentos, asunto que refiriéndonos a los alimentos provenientes de organismos genéticamente modificados, adquiere relevancia, como quiera que la etiqueta constituye el medio de control del cual disponen las personas para garantizar la soberanía alimentaria.
