description The strike, understood as a constitutional right in which a group of workers, unionized or not, carry out a collective cessation of work in order to pressure the employer to achieve an economic or professional improvement, has all the characteristics to be considered a universally recognized human right. Thus, the objective of this article is to analyze the nature of this right, its usefulness, and the material and substantial obstacles that limit its effective recognition as an expression of the rights of association and collective bargaining in the Colombian legal system.

Thus, the objective of this article is to analyze the nature of this right, its usefulness, and the material and substantial obstacles that limit its effective recognition as an expression of the rights of association and collective bargaining in the Colombian legal system. La huelga, entendida como un derecho constitucional mediante el cual un grupo importante de trabajadores, sindicalizados o no, realizan una cesación colectiva del trabajo, con el fin de presionar al empleador para lograr objetivos económicos y profesionales, reúne las características universalmente reconocidas para ser catalogado como derecho humano. El presente artículo tiene como propósito analizar su naturaleza y utilidad, así como los obstáculos materiales y sustanciales que impiden actualmente su reconocimiento efectivo como expresión de los derechos de asociación y contratación colectiva dentro del sistema jurídico colombiano.
