| description | This paper constitutes a first progress report of the research project “Community management of aqueducts, regulatory aspects: characterization of experiences in the commune province (Santander Department), Colombia 2019-2020. The problem to be developed raises the dislocation between the spaces state public and community public about the regulation of rural aqueducts trying to establish the way in which such regulation has been developed in its operation and management. The methodological approach is qualitative, with a phenomenological-hermeneutical focusing, as it seeks to approach the lived experience of the communities around the object of study, clarifying the meaning frameworks on the law produced in that social space. To that extent, the analysis is framed within the theories of legal pluralism from where some categories and variables are proposed for the characterization of the phenomenon. The work links the background check with the results of the first phase of contact and dialogue with the relevante social actors on the subject which took place in the fórum “Community management of aqueducts in the commune province”. In a later report, the results of the immersion and practice phase of the instruments for collecting empirical information will be presented. |

El presente artículo constituye un primer informe de avance del proyecto de investigación “La gestión comunitaria de los acueductos, aspectos regulatorios: caracterización de experiencias en la provincia comunera (departamento de Santander), Colombia 2019-2020. El problema a desarrollar plantea la dislocación entre los espacios público estatal y público comunitario respecto de la regulación de los acueductos rurales, procurando establecer la forma como se ha venido desarrollando tal regulación en su funcionamiento y gestión. El abordaje metodológico es de tipo cualitativo, con un enfoque fenomenológico-hermenéutico, en tanto busca acercarse a la experiencia vivida de las comunidades entorno al objeto de estudio, esclareciendo los marcos de significación sobre el derecho producidos en ese espacio social. En esa medida, el análisis se enmarca en las teorías del pluralismo jurídico, desde donde se plantean unas categorías y variables para la caracterización del fenómeno. El trabajo vincula la revisión de antecedentes con los resultados de la primera fase de contacto e interlocución con los actores sociales relevantes frente al tema, la cual tuvo como escenario el foro “La gestión comunitaria de los acueductos en la provincia comunera”. En un informe posterior se presentarán los resultados de la fase de inmersión y práctica de los instrumentos de recolección de la información empírica.
