Se aplica un enfoque sociojurídico e interdisciplinario, que supera el formalismo y el reduccionismo positivista, que se limita a las normas escritas y a lo que “ellas dicen”. Estudia los servicios públicos como género, se pone el énfasis en los esenciales y se plantean elementos para un replanteamiento de su teoría y de su práctica, de su consagración constitucional y legal, de su garantía formal y material.
