For these reasons, are repeatedly promulgated populist and politicized criminal laws that aim at repression and concealment of social problems; circumstance that places the interests of the few over the majority and that, in turn, sacrifices instrumental function of criminal law to give it a merely symbolic function.

La legislación penal, debido a la gravedad de sus prescripciones, debe quirúrgico de análisis reflexivos, incluyentes y fundamentados en una serie y responsable discusión de su conveniencia, que favorezca la adopción de disposiciones sensatas. Desafortunadamente, esta situación es completamente contraria a lo que sucede en la realidad, pues las medidas punitivas son tomadas por comités de acción y consejeros políticos, impulsados ​​por el sed de venganza, los intereses electorales y el aprovechamiento del estado constante de zozobra en el que se encuentra la ciudadanía. Por tales razones, reiteradamente se sancionan leyes penales populistas y politizadas que tienen como objetivo larepresión y el ocultamiento de los problemas sociales, circunstancia que coloca los intereses de unos pocos por encima de los de la mayoría y que, a su vez, sacrifica la función instrumental del derecho penal para recibir una meramente simbólica.
