A pesar de que las bases filosóficas de la teoría crítica del derecho tienen más de un siglo, en los últimos años se han presentado diferentes polémicas con respecto a las teorías, que en general presentan características comunes, pero a la vez crean confusiones. Este escrito expone la jurisdicción especial indígena de Colombia que, por sus postulados, como se explica en el desarrollo de este documento, podría configurarse como un uso alternativo del derecho, pero para el autor, es un típico ejemplo de pluralismo jurídico.
