description In search of an explanation of the tools that must use the legal operator for making a decision, there have been different methods of interpretation and argumentation, but as the law is constantly evolving, these methods have been insufficient, in the understanding that the law consists not only by rules, but also for principles which today are considered as binding rules. In this regard, to avoid arbitrariness of judge decisions, there are a number of theories that seek to provide a valid and plausible basis for the assessments that determine the legal decision.

In this regard, to avoid arbitrariness of judge decisions, there are a number of theories that seek to provide a valid and plausible basis for the assessments that determine the legal decision. En búsqueda de la explicación de las herramientas de las que se debe valer el operador jurídico para la toma de una decisión, han surgido diferentes métodos de interpretación y argumentación, pero como el derecho  tiene una evolución constante, estos métodos han sido insuficientes, en el entendido de que el derecho no solo está conformado por reglas, sino por los principios que hoy se consideran como normas vinculantes. En este sentido, para procurar que los fallos de los jueces no sean arbitrarios, ha surgido una serie de teorías que pretenden proporcionar un fundamento valido y plausible para las valoraciones que determinan la decisión jurídica.
