description The separation of powers is one of the most important characteristics of modern constitutionalism, which seeks to protect the State against tyrannical Governments. Although it is certain that the separation of powers gives autonomy to each one of these (executive, legislative and judicial), it does not imply that it may arise some form for supplementing the function of a power to other, so here we remit, in terms of the legislative and Judicial (Constitutional) powers, to the manipulative sentences and more exactly to additive or integrative sentences, that are those able to protect the Constitution and complement the legislative work.

La separación de poderes es una de las características más relevantes del constitucionalismo moderno, que busca proteger así al Estado frente a gobiernos tiránicos. Si bien es cierto que la separación de poderes reviste de autonomía a cada uno de estos (ejecutivo, legislativo y judicial), ello no implica que pueda surgir forma alguna de complementar la función de un poder a otro, por eso aquí nos remitiremos, en cuanto a lospoderes legislativo y judicial (constitucional), a las sentencias manipulativas, y, más exactamente, a las “sentencias aditivas o integradoras”, que son aquellas capaces de hacer proteger la Constitución Política y de complementar la labor legislativa.
