Este artículo busca caracterizar la vulneración del derecho a la salud y la situación actual de la salud en Colombia, teniendo en cuenta que este derecho se encuentra enmarcado en el modelo económico neoliberal. Según la medicina social,la salud es un estado de bienestar integral y no solo la ausencia de enfermedad. Se propone al Estado como responsable de la garantía de derechos del sujeto, en este caso, sujeto consumidor de sustancias psicoactivas (SPA), que responde a una construcción sociohistórica, desde los contextos sociales como educación, trabajo, nutrición,y que exige la propiedad de la tierra para ser reconocido con igualdad de derechos.
