description Transitional justice, understood as the measures taken by a government after the conflict, have been taken up by the national government in the Peace Accords signed with the Revolutionary Armed Forces of Colombia (FARC); however, in this transitional justice, gaps have been found in the concept of victims and integral reparation, since it only understands as victims civilians and members of the Police and Army, who have been directly or indirectly affected by the internal armed conflict, leaving aside the consequences that the active subjects of the war can suffer with respect to their emotional and psychological health. Therefore, this paper aims to analyze if the active agents, especially members of the Police and Army, are victims of the internal armed conflict that must be taken into account as such in the so-called Colombian transitional justice.

La justicia transicional, entendida como las medidas que toma un gobierno con posterioridad al conflicto, han sido retomadas por el Gobierno nacional en los Acuerdos de Paz firmados con las Fuerzas Armadas Revolucionarias de Colombia (FARC); sin embargo, en esta justicia transicional se han encontrado vacíos en el concepto de víctimas y la reparación integral de las mismas, ya que solo entiende como víctimas a los civiles y miembros de la Fuerza Pública, que de manera directa o indirecta se han visto afectados por el conflicto armado interno, dejando a un lado las secuelas que pueden sufrir los sujetos activos de la guerra respecto a su salud emocional y psicológica. Por lo anterior, el principal objetivo de este artículo es analizar si los agentes activos, especialmente los miembros de la Fuerza Pública, son víctimas del conflicto armado interno que deban ser tenidos en cuenta como tales en la denominada justicia transicional colombiana.
