En Colombia debería haber una acción de inexistencia de actos administrativos, que deje sin eficacia los actos administrativos que por error de la administración nazcan a la vida jurídica y que violen derechos fundamentales, a fin de precaver el daño inminente que se pueda causar. Además, se tendría la posibilidad de la tutela contra las decisiones oficiales, mal llamadas vías de hecho, que podrían limitar la eficacia de los actos administrativos expedidos con ausencia de los requisitos de existencia por errores.
