Thus, the classic definitions of positive and negative liberty are taken into account to determine which of these two meanings is the most prevalent in the judgments of the Court and thereby to establish whether the formulation of Social State of Law set forth in the Constitution, which prioritizes the positive duties of the State, is real and effective. This analysis will be based on some paradigmatic cases in which the freedom of conscience right has been violated. El artículo hace un análisis hermenéutico del concepto de libertad, con el fin de entender en qué sentido la libertad de conciencia, que es una forma positiva de la libertad en sentido filosófico, es entendida en las disposiciones de la Corte Constitucional colombiana. Se abordan de este modo las definiciones clásicas de libertad positiva y libertad negativa, para determinar cuál de estas dos acepciones es la más predominante en las sentencias de la Corte y establecer de ese modo si la formulación de Estado social de derecho estipulada en la Carta Política, la cual privilegia los deberes positivos del Estado, es real y efectiva. Dicho análisis estará basado en algunos casos paradigmáticos, en los cuales el derecho a la libertad de conciencia se ha visto vulnerado.
