El presente artículo va dirigido a estudiantes y profesionales del derecho, con el fin de construir un ejercicio de la profesión consciente ante las consecuencias que principalmente en materia disciplinaria enmarcan nuestras actuaciones, no solo como abogados, también aquellos que a su vez ostentan la calidad de funcionarios públicos. Se busca establecer si se da la vulneración del principio non bis in idem al aplicar el régimen disciplinario del abogado y el del servidor público a un profesional del derecho que ejerce función pública como apoderado al servicio del Estado, para ello se hace necesario establecer los tipos de vinculación del abogado con la administración, los regímenes disciplinarios existentes para los abogados y para los servidores públicos y finalmente comparar estos últimos a partir de los presupuestos del principio del non bis in idem para determinar si hay lugar o no a su vulneración.
