Therefore, it is necessary to affirm emphatically that the military criminal justice system could be specialfrom the standard criminal justice system, but cannot be uneven or biased, because if that happens, it is no longer justice.

Este trabajo pretende lograr un adecuado entendimiento de la justicia penal militar y de la institución del fuero penal para las Fuerzas Militares –en adelante FF.MM.– y de Policía, derivado del artículo 221 de la Constitución Política de 1991, pues, como todos los fueros en Colombia, en principio, se hicieron no para privilegiar a las personas que ostentan una determinada condición o dignidad, sino para preservar el cargo o la función pública que desempeñan. Por lo tanto, es necesario decir enfáticamente, que la justicia penal militar puede ser especial, pero no puede ser desigual ni parcializada, porque deja de ser justicia.
