description This qualitative, research aims to analyze the scope of protection, recognition and access to health services for people deprived of liberty at the Medium Security and Prison Establishment in Tunja, Colombia during the 2005-2018 period. This objective involves the participation of the state, municipal, and control agencies such as Municipal Ombudsman, the Ombudsman and the Attorney General of the Nation, in order to demand the provision of medical-care services, within the framework of the State of Things Unconstitutional and Prison Emergency. The method used in this sense was the documentary analysis of two types of sources: a) the review of authors on the evolution of the right to health in prison matters, and b) the deficit and emergence of the prison health care model. The results show that the EPMSC of Tunja is one of the least crowded prison settings in the country, wich it has had a scope and scenario of denial, weak and tenuous to satisfactory, favoring the participation of the HR committee, and mainly depending on the balance economic model of health care. Consequently, it implies that sustainability and infrastructure must be required in the Tunja prison scenario, for the guarantee and enforceability of the human right to health.

Esta investigación cualitativa, pretende analizar los alcances prestacionales de protección, reconocimiento y acceso al servicio de salud en personas privadas de la libertad en el Establecimiento Penitenciario de Mediana Seguridad y Carcelario - EPMSC de Tunja, durante el periodo 2005-2018. Este objetivo involucra la participación estatal, municipal, y de los organismos de control como la Personería Municipal, la Defensoría del Pueblo y la Procuraduría General de la Nación, a fin de exigir la prestación de los servicios médico- asistenciales, en el marco del Estado de Cosas Inconstitucional y de Emergencia Carcelaria. El método utilizado en este sentido fue el análisis documental de dos tipos de fuentes: a) la revisión de autores en materia de evolución del derecho a la salud en materia carcelaria, y b) el déficit y surgimiento del modelo de atención en salud penitenciaria. Los resultados muestran que el EPMSC de Tunja, es uno de los escenarios penitenciarios menos hacinados del país, el cual ha tenido un alcance y escenario de negación, débil y tenue a satisfactorio, propiciando la participación del comité en DDHH, y dependiendo principalmente del equilibrio económico del modelo de atención en En consecuencia, implica que se debe requerir sostenibilidad e infraestructura en el escenario carcelario tunjano, para la garantía y exigibilidad del derecho humano a la salud. Esta pesquisa qualitativa tem como objetivo analisar o alcance dos benefícios de proteção, reconhecimento e acesso aos serviços de saúde em pessoas privadas de liberdade no Estabelecimento Penitenciário e Prisional de Média Segurança - EPMSC de Tunja, durante o período 2005-2018. Esse objetivo envolve a participação dos órgãos estaduais, municipais e de controle, como a Personería Municipal, a Ouvidoria e a Procuradoria Geral da República, para exigir a prestação de serviços de assistência médico-assistencial, no âmbito do Estado. O método utilizado nesse sentido foi a análise documental de dois tipos de fontes: a) a revisão de autores sobre a evolução do direito à saúde em matéria prisional, e b) o déficit e a emergência do modelo de atenção à saúde prisional. Os resultados mostram que a EPMSC de Tunja é um dos cenários prisionais menos lotados do país, que tem tido um âmbito e cenário de negação, fraco e ténue a satisfatório, promovendo a participação da comissão de Direitos Humanos, e dependendo principalmente de o modelo económico de cuidados de equilíbrio em Consequentemente, implica que a sustentabilidade e infra-estruturas devem ser exigidas no ambiente prisional em Tunja, para a garantia e exigibilidade do direito humano à saúde.
