description The text focuses on national policies for Distance Higher Education (DHE) and aims to analyze the trajectory of policies under this modality and to reflect on the challenges that its growth poses for ensuring the quality of education. It is a documentary and bibliographic research, supported by a careful search of the legislation that rules and organizes the offer of distance higher education in Brazil, complemented by a careful review of the literature from authors who discuss the subject. The DHE regulation at the national level was consolidated with the approval of Federal Law No. 9.394 of December 20, 1996, Ley de Directrices y Bases de la Educación Nacional –LDBEN- (law on guidelines and bases of national education), giving way to a period of incentive for the implementation of this modality. In 2017, Federal Decree No. 9.057 of 25 May, supplemented by Portaria Regulation No. 11 of 20 June 2017, significantly altered the legislation and standardization of the Brazilian DHE with a strong favoring towards the accelerated expansion of distance higher education. Brazil has considerable challenges to be faced with regard to DHE, among which the quality of the education offer stands out, including service provision, access and permanence of students in higher education, the use of digital technologies and the expansion of this modality.

Se trata de una investigación documental y bibliográfica, sustentada por una búsqueda cuidadosa de la legislación que disciplina y organiza en Brasil la oferta de la educación superior a distancia complementada con cuidadosa revisión de literatura a partir de autores que discuten el tema. La reglamentación de la EaD a nivel nacional se consolida ante la aprobación de la Ley Federal nº 9.394 del 20 de diciembre de 1996, Ley de Directrices y Bases de la Educación Nacional (LDBEN), iniciando un período de incentivo a la implementación de esa modalidad. En el año 2017, el Decreto Federal nº 9.057 del 25 de mayo, complementado por la Portaría Normativa nº 11 del 20 de junio de 2017, altera significativamente la reglamentación y normatización de la EaD brasileña, favoreciendo fuertemente la expansión acelerada de la educación superior a distancia. Brasil tiene desafíos considerables a ser enfrentados en lo que se refiere a EaD, entre estos se puede destacar la calidad de la educación ofrecida, incluyendo la prestación del servicio, el acceso y la permanencia de los alumnos en la educación superior, la utilización de tecnologías digitales y la expansión de esta modalidad.   O texto com foco nas políticas nacionais para a educação superior a distância (EaD) tem como objetivo analisar a trajetória das políticas para esta modalidade e refletir acerca dos desafios que seu crescimento vem colocando para assegurar a qualidade da educação. Trata-se de uma investigação documental e bibliográfica, sustentado por uma busca cuidadosa da legislação que, no Brasil, disciplina e organiza a oferta da educação superior a distância, complementada com cuidadosa revisão de literatura a partir de autores que discutem o tema. A regulamentação da EaD em âmbito nacional consolida-se ante a aprovação da Lei Federal no. 9.394, de 20 de dezembro de 1996, Lei de Diretrizes e Bases da Educação Nacional (LDBEN), iniciando um período de incentivo à implementação dessa modalidade. Em 2017, o Decreto Federal no.9.057, de 25 de maio, complementado pela Portaria Normativa no. 11, de 20 de junho de 2017, altera, significativamente, a regulamentação e normatização da EaD brasileira, favorecendo fortemente a expansão acelerada da educação superior a distância.
