The objective of this work was to reveal some of its vicissitudes generated because of the absence of regulations, in such a way as to provoke in the reader a reflection on how necessary it is to regulate this atypical contract. The methodology used was based on the review of jurisprudence, doctrine, concepts issued by administrative entities and even the practical experience of those who operate with these contracts. As a result, it is suggested the creation of a legislative provision that in an agile way resolves the factual assumptions generating consequences that without it would not be logical. |

La atipicidad del contrato de leasing, enfrenta a sus partes a distintas situaciones que carecen de seguridad jurídica, que, quizá por su naturaleza contractual, invita a ejercicios de interpretación que pueden resultar desafortunados para la adecuada materialización del contrato. El objetivo de este trabajo consiste en develar varias de sus vicisitudes generadas ante la ausencia de normativa, de tal forma que se provoque en el lector una reflexión acerca de la necesidad o no de regular este atípico contrato. La metodología empleada radicó en la revisión de jurisprudencia, doctrina, diferentes conceptos emitidos por entidades administrativas e inclusive la experiencia práctica de quienes operan con estos contratos. Como resultado, se sugiere la creación de una disposición normativa que, de forma ágil, resuelva los supuestos de hecho, generando consecuencias que quizá sin ella no resultarían lógicas. a atipicidade do contrato de locação, confronta as suas partes com diversas situações de falta de segurança jurídica, o que, talvez pela sua natureza contratual, convida a exercícios de interpretação que podem ser desastrosos para a adequada concretização do contrato. O objetivo deste trabalho é revelar várias de suas vicissitudes geradas na ausência de regulamentação, de tal forma que o leitor seja provocado a refletir sobre a necessidade ou não de regular esse contrato atípico. A metodologia utilizada baseou-se na revisão de jurisprudência, doutrina, diferentes conceitos emitidos por entidades administrativas e até mesmo na experiência prática de quem opera com esses contratos. Como resultado, sugere-se a criação de um dispositivo normativo que, de forma ágil, resolva os pressupostos fáticos, gerando consequências que talvez não tivessem lógica sem ele.
